Welcome to BootFit! These Terms of Service ("Terms") govern your access to and use of our website, services, and content ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using BootFit, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

BootFit provides:

Rental car boot capacity information and visualizations
Luggage packing calculators and recommendations
User-generated content including photos and packing examples
Premium features for paid subscribers
Affiliate links to rental car booking services

The information is provided "as is" for informational purposes only. While we strive for accuracy, we make no guarantees regarding the complete accuracy of boot capacity data, luggage dimensions, or packing recommendations.

3. Account Registration

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security of your password
Notify us immediately of any unauthorized use of your account
Be responsible for all activities under your account

You must be at least 13 years old to create an account. We reserve the right to refuse service or terminate accounts at our discretion.

4. Subscription Plans and Payments

Plans and Pricing

BootFit offers multiple subscription tiers:

Free: Basic access with limited features
Travel Pass: 7-day full access at the published rate
Premium: 30-day full access at the published rate

Prices are displayed in multiple currencies and are subject to change with notice.

Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your full credit card information on our servers.

Subscriptions and Renewals

Travel Pass and Premium subscriptions are for fixed periods (7 days or 30 days respectively) and do not automatically renew. Access expires at the end of the purchased period unless you purchase a new subscription.

Refund Policy

Due to the nature of digital content and immediate access upon purchase, all sales are final. We do not offer refunds except:

In cases of technical errors that prevent access to purchased features
If legally required in your jurisdiction
At our sole discretion in exceptional circumstances

For refund requests, contact us at support@getbootfit.com within 48 hours of purchase.

5. User-Generated Content

Your Content

Our Service allows you to submit information, including luggage configurations, photographs, and feedback ("User Content"). You retain ownership of your User Content.

License Grant

By submitting User Content to BootFit, you grant us a worldwide, non-exclusive, royalty-free, perpetual, transferable license to use, reproduce, display, modify, and distribute your Content in connection with operating and promoting the Service. This includes displaying your photos on car detail pages to help other users.

Your Responsibilities

You represent and warrant that:

You own or have the right to submit the User Content
Your Content does not violate any third party's rights
Your Content does not contain personal information of others without consent
Your photos do not show license plates or other identifiable information

Content Moderation

We reserve the right to review, approve, reject, or remove any User Content at our sole discretion. We may remove content that violates these Terms or is otherwise objectionable.

6. Prohibited Conduct

You agree not to:

Use the Service for any illegal purpose
Post content that is defamatory, obscene, offensive, or hateful
Infringe on any intellectual property rights
Share others' private information without consent
Attempt to gain unauthorized access to the Service or other users' accounts
Interfere with or disrupt the Service or servers
Use automated systems (bots, scrapers) to access the Service
Reverse engineer or attempt to extract source code
Circumvent payment systems or access controls
Impersonate others or misrepresent your affiliation

7. Intellectual Property Rights

Our Content

The Service, including its design, features, text, graphics, logos, and software, is owned by BootFit and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

We use third-party services to operate BootFit, including:

Stripe: Payment processing
Supabase: Database and authentication
Sentry: Error monitoring
Google Analytics & Vercel Analytics: Usage analytics
Resend: Email delivery

Your use of these services through BootFit is subject to their respective terms of service and privacy policies.

Affiliate Links

Our Service contains affiliate links to rental car booking services. If you make a purchase through these links, we may earn a commission at no extra cost to you. We are not responsible for the products, services, or conduct of these third parties.

Third-Party Websites

We are not responsible for the content, accuracy, or practices of third-party websites linked from our Service. Your interactions with third parties are solely between you and them.

9. Privacy and Data Collection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Accuracy of Information

While we strive for accuracy, we do not warrant that:

Boot capacity measurements are exact for all vehicle variants
Luggage calculations will perfectly predict real-world packing
User-contributed photos represent all possible configurations
The Service will be error-free, secure, or uninterrupted

Your Responsibility

You are solely responsible for:

Verifying all information with your rental car provider
Measuring your actual luggage before booking
Ensuring your luggage will fit based on your specific needs
Any decisions made in reliance on information from the Service

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOTFIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Costs of obtaining substitute services
Decisions made or actions taken based on Service information
Issues arising from rental car bookings made through affiliate links
Luggage not fitting despite using our Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $100 AUD, WHICHEVER IS LESS.

We are not a party to any rental car agreement you enter into and have no liability for any disputes between you and rental car companies.

12. Indemnification

You agree to indemnify, defend, and hold harmless BootFit and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any rights of another party

13. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for:

Violation of these Terms
Fraudulent or illegal activity
Abuse of the Service or other users
Payment failures or disputes

You may delete your account at any time through your account settings or by contacting us. Upon termination:

Your right to access the Service will immediately cease
Paid subscriptions are non-refundable
We may delete your account data per our data retention policy
User Content may remain publicly visible unless removal is requested

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on this page
Updating the "Last Updated" date
Sending email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.

15. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at legal@getbootfit.com to attempt to resolve the dispute informally.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from these Terms or the Service shall be resolved in the courts of Victoria, Australia, and you consent to the exclusive jurisdiction of those courts.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BootFit regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.

Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, or network failures.
